Acceptance of Terms

By registering for and/or using the services provided by Bhoomicam Private Limited ("Service") in any manner, including but not limited to visiting or browsing the site, you agree to all the terms and conditions listed in this document ("Terms of Service") as well as all other operating rules, policies, and procedures that Bhoomicam may publish from time to time on the site. These may be updated periodically without notice to you, as outlined under the "Modification of Terms of Service" section below. Additionally, some services offered through the Service may be subject to additional terms and conditions specified by Bhoomicam from time to time; your use of such services will also be governed by those additional terms, which are incorporated into these Terms of Service by reference. These Terms apply to all users of the Service, including but not limited to contributors of content, information, and materials, individual users, venues that access the Service, and users with an account on the Service.

Access

Subject to these Terms of Use, Bhoomicam offers to provide the Service as described on the site, which you may select solely for your personal use, not for the benefit of any third party. Services include, but are not limited to, any services Bhoomicam performs for you, any applications or widgets offered by Bhoomicam that you download from the site or, under the terms of the "Third Party Sites and Services" section below, from third-party stores like iTunes® or Google Play, and any materials displayed or performed on or through the Services (collectively referred to as "Content").

Registration and Eligibility

To access the site and use the Service, you must register with Bhoomicam and provide accurate, complete registration information, including a user name ("User Name"), email address, and/or mobile telephone number, and a password. You are responsible for keeping your registration information accurate and up-to-date. Failing to do so constitutes a breach of these Terms, which may result in the immediate termination of your account. It is recommended, though not required, that you use your real name for your User Name.

You must not:

  • Create an account for anyone other than yourself without their permission.
  • Use a username that impersonates someone else.
  • Use a username or account belonging to another person without proper authorization.
  • Use a username that is offensive, vulgar, obscene, or unlawful.

    • Bhoomicam reserves the right to refuse registration or cancel a User Name at its discretion. You are responsible for all activities that occur on your account and for maintaining the confidentiality of your password. You must never use another user’s account without their express permission. Notify Bhoomicam in writing of any unauthorized use of your account or any security breaches.

    You represent and warrant that you are either of legal age to form a binding contract or, if registering on behalf of an entity, that you are authorized to enter into and bind the entity to these Terms of Use. The Service is not available to individuals under 18 unless represented through a legal guardian. Bhoomicam reserves the right to refuse the Service to any person or entity and may change its eligibility criteria at any time.

    You are solely responsible for ensuring that these Terms of Use comply with all laws, rules, and regulations applicable to you. Access to the Service is revoked in areas where these Terms of Use or use of the Service is prohibited, and in such cases, you agree not to use or access the site or Service in any manner.

    If you use a mobile device, your carrier’s standard rates and fees, such as text messaging and data charges, may apply. If you change or deactivate your mobile phone number, you must update your account information within 48 hours to ensure that your messages are not sent to the new holder of your previous number.

    Content

    All Content, whether publicly posted or privately transmitted, is the sole responsibility of the individual who created or originated it. Bhoomicam cannot guarantee the authenticity of any Content or data provided by users about themselves. You acknowledge that accessing any Content via the Service is at your own risk, and you are solely responsible for any resulting damage or loss to you or others. For the purposes of these Terms, "Content" includes, but is not limited to, location information, video clips, audio clips, responses, data, text, photographs, software, scripts, graphics, and interactive features made available by Bhoomicam through the Service. User-generated Content, including that added in connection with accounts linked to third-party services, is collectively referred to as "User Submissions."

    Bhoomicam Content

    The Service may contain Content provided by Bhoomicam or its partners, which is protected by copyright, trademark, patent, trade secret, or other proprietary rights and laws, as applicable. You are required to comply with all copyright notices, information, and restrictions associated with any Content accessed via the Service. Subject to these Terms, Bhoomicam grants each user of the Service a worldwide, non-exclusive, non-sublicensable, and non-transferable license to access and view or listen to the Content for personal, non-commercial use only. The use, reproduction, modification, distribution, or storage of Content for purposes other than personal, non-commercial use is prohibited without prior written permission from Bhoomicam or the copyright holder indicated in the Content's copyright notice. You may not sell, license, rent, or otherwise exploit the Content for commercial purposes or in any way that violates third-party rights.

    Downloadable Content

    Content may be made available for download at Bhoomicam's discretion, including audio on-demand and other downloadable formats for offline access. Please note the following regarding downloadable Content:

    • Downloads are temporary, allowing you to access or listen to the Content for a specified period. You may not attempt to create a permanent copy of the Content.
    • Not all Content may be available for download or offline access.

    Access and Availability of Content

    The availability of Content or certain services may be subject to Bhoomicam's sole discretion, geographical location, device specifications, internet availability, and other factors. You acknowledge that access to the Site and the Services is at your own risk and discretion, and you are responsible for ensuring your use complies with applicable laws in your jurisdiction. Content and services may vary by location, time, and device, and Bhoomicam reserves the right to monitor activities using certain technologies, as described in our Privacy Policy. Bhoomicam offers various models for accessing the Service, including:

    • Free of charge (may include advertisements)
    • Subscription-based (via payment under a Subscription Plan)
    • Pay-per-view (with or without advertisements)
    • A combination of the above models
    Note that some Content may include advertisements, even under certain advertisement-free subscription plans.

    User Submissions

    Bhoomicam may use your User Submissions in various ways in connection with the Site, Service, and Bhoomicam's business as determined at its sole discretion. This includes, but is not limited to, publicly displaying, reformatting, incorporating into marketing materials, advertisements, creating derivative works, distributing, promoting, and allowing other users to do the same with your User Submissions on third-party websites, media platforms, or applications ("Third Party Media"). By submitting User Submissions through the Site or Service, you grant Bhoomicam a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, copy, modify, reproduce, distribute, adapt, translate, prepare derivative works of, display, perform, and fully exploit your User Submissions in connection with the Site, Service, and Bhoomicam's business. This includes promoting and redistributing parts or all of the Site or Service in any media formats and through any media channels. Additionally, you grant each user of the Site, Service, and Third Party Media a non-exclusive license to access, edit, modify, reproduce, distribute, and perform your User Submissions for their use of the Site and Service. This license does not affect your ownership of your User Submissions, and you retain the right to grant additional licenses to your content unless otherwise agreed in writing with Bhoomicam. You represent and warrant that you have the rights to grant this license without violating any third-party rights, including privacy, publicity, copyright, contract, or any other intellectual property rights. You understand that Bhoomicam is not responsible for the accuracy or authenticity of User Submissions, nor does Bhoomicam guarantee the identity of any users you may interact with through the Service. User Submissions reflect the opinions of the individuals who post them, not Bhoomicam, and Bhoomicam is not responsible for any misinformation or out-of-date content in User Submissions. When you delete your User Submissions, they will be removed from the Service. However, they may persist in backup copies for a reasonable period and may remain accessible to users who previously downloaded them.

    Rules and Conduct

    As a condition of using the Service, you agree not to use it for any prohibited purposes under these Terms of Use. You are responsible for all activity connected with your use of the Service and must comply with all applicable laws, regulations, and codes.

    You agree not to take any action or distribute any Content or User Submission that:

  • Belongs to someone else and is used without permission;
  • Is defamatory, obscene, pornographic, invasive of privacy, harassing, libelous, racially or ethnically objectionable, or unlawful;
  • Is harmful to children;
  • Infringes any intellectual property rights;
  • Violates any current law;
  • Misleads others about the origin of a message or intentionally shares false information;
  • Impersonates another person;
  • Threatens national security or public order;
  • Contains viruses or harmful software designed to interrupt or limit computer functionality;
  • Is written or published with the intent to mislead or harm others for personal gain.

    • Bhoomicam does not guarantee that any User Submission will be available through the Service and is not obligated to monitor the Site or Content. Bhoomicam reserves the right to remove, suspend, or modify any Content, including User Submissions, at any time, for any reason, or no reason at all, without notice.

    Bhoomicam may also remove or block any User Submission and access, read, and disclose any information it believes necessary to:

  • Comply with laws, regulations, or legal requests;
  • Enforce these Terms of Use;
  • Address fraud, security, or technical issues;
  • Respond to user support requests;
  • Protect the rights, property, or safety of Bhoomicam, its users, or the public.

    Permissions and Restrictions

    You may use the Services provided by Bhoomicam for personal and non-commercial purposes, as long as you comply with the Terms of Use and applicable laws. However, using the Services does not grant you ownership of or rights to any aspect of the Services, including usernames or other content available on the Site.

    The following restrictions apply to your use of the Services. You are not allowed to:

  • Access, copy, reproduce, download, distribute, transmit, broadcast, display, sell, license, alter, modify, or otherwise use any part of the Services or content without prior written permission from Bhoomicam and, if applicable, the respective rights holders;
  • Circumvent, disable, fraudulently engage with, or otherwise interfere with any part of the Services (or attempt to do so), including security features or features that prevent or restrict the copying or use of Content or limit the use of the Services or Content;
  • Access or copy the contents of the Site using manual or automated means, such as robots, spiders, crawlers, or scrapers, or any interface designed to access the Content or extract user information;
  • Use the Services in a way that interferes with, disrupts, or negatively affects other users' ability to enjoy the Services, or that could damage, disable, overburden, or impair the Site’s functioning;
  • Attempt to bypass any content-filtering techniques or access areas or features of the Services that you are not authorized to access;
  • Use or attempt to use another user’s account, username, or password without their permission;
  • Solicit login credentials from another user;
  • Use the Services for illegal or unauthorized purposes, and international users must comply with all local laws regarding online conduct and acceptable content;
  • Post content that contains or links to pornography, graphic violence, threats, hate speech, or incitements to violence;
  • Misuse any reporting, flagging, complaint, dispute, or appeals process by making groundless, vexatious, or frivolous submissions;
  • Use the Services to view or listen to content on the Site for purposes other than personal, non-commercial use; or
  • Use the Services to sell advertising, sponsorships, or promotions placed on, around, or within the Services or content, except as explicitly allowed in writing by Bhoomicam.

  • Undertake any activities that may pose cyber security threats to our products/services or may try to make our product/service unserviceable.
  • You are also advised to refrain from attempting any unauthorized access to Bhoomicam's products, databases, confidential information, records and other such data, failing which Bhoomicam reserves the right to take legal/lawful action deemed fit by Bhoomicam.

    • Technical Failures

    While using the Services, you may experience disruptions such as errors, disconnections, or communication interference related to internet services, software, or hardware. Bhoomicam is not responsible for such factors causing disruptions or interruptions. You accept full responsibility for any risk of loss or damages caused due to interruptions or errors, with complete knowledge of the potential risks involved.

    Advertisements, Third-Party Sites, and Services

    Some of Bhoomicam's Services are supported by advertising revenue and may display advertisements, promotions, and links to third-party websites. By using the Services, you agree that Bhoomicam may place such advertisements and promotions on the Services or in connection with your Content, including User Submissions. The manner, mode, and extent of such advertisements are subject to change without specific notice to you.

    The Service may allow you to link to other websites, services, or resources on the Internet, and other websites or resources may contain links to the Site. When you access third-party websites, you do so at your own risk. These websites are not under Bhoomicam's control, and Bhoomicam is not responsible for the content, functionality, accuracy, legality, or any other aspect of such websites or resources. The inclusion of any link does not imply endorsement by Bhoomicam or any association with its operators. Bhoomicam will not be liable for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party websites or resources.

    Termination

    Bhoomicam may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. This may result in the forfeiture and destruction of all information associated with your account. If you wish to terminate your account, you may do so by contacting Bhoomicam at support@bhoomicam.com. Any fees, including subscription charges, paid hereunder are non-refundable.

    Provisions of these Terms of Use that by their nature should survive termination will continue to remain effective, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

    Warranty Disclaimer

    Except as required by law, Bhoomicam has no special relationship with or fiduciary duty to you. Bhoomicam does not control and has no obligation to act regarding:

  • Which users access the Service;
  • What Content you access via the Service;
  • What effects the Content may have on you;
  • How you may interpret or use the Content; or
  • What actions you take based on your exposure to the Content.

    • Bhoomicam may provide you with Content, such as information, reports, or actionable insights, intended for your reference. However, Bhoomicam does not guarantee the accuracy or efficacy of this information, nor does it warrant that its use will produce specific outcomes or meet your expectations.

    The Service may contain Content or links to websites containing information that some may find offensive or inappropriate. Bhoomicam makes no representations about the accuracy, legality, or decency of such Content, and cannot be held liable for third-party claims, losses, or damages. You release Bhoomicam from all liability concerning your acquisition or lack of acquisition of Content via the Service.

    Bhoomicam also makes no guarantees regarding other users' conduct or the veracity of any information they provide. You agree to take reasonable precautions when interacting with individuals you meet through the Services, particularly if meeting in person. For example, you should not provide personal financial information (e.g., credit card or bank account numbers) to others.

    THE SITE, SERVICE, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF TITLE, NONINFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. ALL SUCH WARRANTIES ARE EXPRESSLY DISCLAIMED, EXCEPT WHERE REQUIRED BY LAW.

    Bhoomicam, its team, directors, employees, agents, representatives, suppliers, partners, and content providers do not warrant that:

  • The Service will be secure or available at any specific time or location;
  • Any defects or errors will be corrected;
  • Any content or software available through the Service is free of viruses or other harmful components;
  • The results of using the Service will meet your requirements.

    • Your use of the Site, Service, and Content is solely at your own risk. Some jurisdictions do not allow limitations on implied warranties, so the above limitations may not apply to you.

    Indemnification

    You agree to defend, indemnify, and hold Bhoomicam, its affiliates, and their respective employees, contractors, directors, suppliers, and representatives harmless from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use or misuse of the Site, Service, Content, or User Submissions, your violation of these Terms of Use, or the infringement of any intellectual property or other rights of any person or entity by you or any third party using your account. Bhoomicam reserves the right to assume the defense and control of any matter subject to indemnification by you, in which case you will cooperate fully with Bhoomicam in asserting any available defenses.

    Limitation of Liability

    ALL LIABILITY OF BHOOMICAM, ITS DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS FOR ANY LOSS OR DAMAGES ARISING OUT OF YOUR USE OF THE SITE, SERVICE, CONTENT, OR USER SUBMISSIONS IS EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW. HOWEVER, IF A COURT OF COMPETENT JURISDICTION DETERMINES LIABILITY OF BHOOMICAM, ITS DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS, SUCH LIABILITY WILL BE LIMITED TO AN AGGREGATE AMOUNT OF ONE THOUSAND RUPEES (Rs.1000).

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BHOOMICAM, NOR ITS DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, PARTNERS, SUPPLIERS, OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL THEORY FOR:

  • INDIRECT OR CONSEQUENTIAL LOSSES OR DAMAGES;
  • LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA;
  • WASTED EXPENDITURE OR COSTS OF SUBSTITUTE GOODS OR SERVICES.

    • APPLICABLE LAW MAY NOT ALLOW LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH CASES, BHOOMICAM'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

    Integration and Severability

    These Terms of Use constitute the entire agreement between you and Bhoomicam regarding the Service and supersede all prior communications and proposals. If any provision is found to be invalid or unenforceable, it will be limited or eliminated to the minimum extent necessary, so that these Terms remain enforceable. Failure to exercise any right does not constitute a waiver of future rights. Any waiver of compliance with these Terms requires written notice from Bhoomicam.

    Modification of Terms of Use

    Bhoomicam reserves the right to modify or replace these Terms of Use, or to change, suspend, or discontinue the Service (including features or content) at any time by posting a notice on the Site or sending you notice via email. Bhoomicam may impose limits on certain features or restrict your access without notice or liability. It is your responsibility to check these Terms periodically. Continued use of the Service after changes constitutes acceptance of those changes.

    Other Provisions

    Claims of Copyright or Trademark Infringement

    If you believe someone is infringing your copyright or trademark on Bhoomicam, report it by contacting us at support@bhoomicam.com with the following details:

  • Complete contact information (name, address, phone number);
  • Description of the allegedly infringing content and how it infringes on your rights;
  • Web address (URL) of the infringing content;
  • Declaration that the report is made in good faith, with accurate information, and that you are the copyright/trademark owner;
  • Digital or physical signature.

    • Upon receiving your report, Bhoomicam will acknowledge the take-down request within 24 hours and assess the issue. Content may be removed as required by law. If a court injunction is obtained within 21 days, the content will be permanently removed. Otherwise, it may be restored for public view.

    Notice

    Bhoomicam may provide you with notices via general announcements on the Services, notifications within your account on the Site, emails to the email address listed in your account, or by written communication to the physical address associated with your account.

    General

    You may not assign or transfer these Terms of Use without Bhoomicam's prior written approval. Bhoomicam may assign or transfer these Terms of Use in whole or in part to:

  • A subsidiary or affiliate;
  • An acquirer of Bhoomicam’s equity, business, or assets;
  • A successor by merger.

    • No joint venture, partnership, employment, or agency relationship exists between you and Bhoomicam or any third-party provider due to the contract between you and Bhoomicam or your use of the Services.

    If any provision of these Terms of Use is found to be illegal, invalid, or unenforceable under any applicable law, that provision will be deemed to be removed, and the legality, validity, and enforceability of the remaining provisions shall not be affected. In such a case, the parties will replace the illegal, invalid, or unenforceable provision with a provision that is legal, valid, and enforceable and that most closely achieves the same effect. These Terms of Use represent the entire agreement between you and Bhoomicam concerning its subject matter and supersede all prior or contemporaneous agreements.

    The terms "including" and "include" mean "including, but not limited to."

    Miscellaneous

    Bhoomicam shall not be liable for any failure to perform its obligations under these Terms of Use due to any cause beyond its reasonable control, including mechanical, electronic, or communication failures or degradation. These Terms of Use are personal to you and are not assignable or transferable without Bhoomicam's prior written consent. Bhoomicam may assign or delegate any of its rights and obligations without your consent. No partnership, joint venture, or employment relationship is created as a result of these Terms of Use, and neither party has authority to bind the other in any way.

    Unless specified otherwise, all notices under these Terms of Use must be in writing and will be deemed duly given when sent through registered post on official address of Bhoomicam.

    Cancellation & Refund Policy

    At Bhoomicam Private Limited, we strive to assist our customers as much as possible, and thus maintain a flexible cancellation policy. Under this policy:

  • Cancellation requests will be accepted only if made immediately after placing the order. However, the request may not be processed if the order has already been communicated to the merchants, and the subscription process has begun.
  • If you believe that the service received does not match what was shown on the website or your expectations, you must inform our customer service team at support@bhoomicam.com on the same day you receive the product. The team will review your complaint and take appropriate action.
  • For any refunds approved by Bhoomicam Private Limited, please allow 6-8 days for the refund to be processed to your account.
